Musical works are included as Intellectual Properties under the heading of copyright. Last week we mentioned that when you create a musical work, you immediately have copyright protection. Enjoying the full legal protection of your copyright will entail registering your works with the Intellectual Property Office in your territory. What might not be common knowledge is that there can be two copyrights for a song you have written. The first copyright is the one that is granted as soon as you create the musical work, as the creative spark comes to you. The second copyright will be granted once you make a recording of that same song. In other words, the copyright of a sound recording is different from the copyright of a musical work. The LegalZoom website a a great article about this. The Canadian Intellectual Property Office’s website has a Guide to Copyright which is a wonderful resource. Again different territories may have differing lengths of term and definitions but most countries are part of the Berne Convention so there is some common ground when talking about copyright.
